Sitemize üye olarak, Kullanıcı Sözleşmesi’ni okuduğunuzu, içeriğini anladığınızı ve hükümlerini kabul ettiğinizi ve onayladığınızı kabul, beyan etmiş oluyorsunuz.

Parties
İşbu sözleşme ve sözleşmenin ayrılmaz birer parçası olan eklerden oluşan Win In Turkey Kullanıcı Sözleşmesi (bundan böyle kısaca ‘Kullanıcı Sözleşmesi’ olarak anılacaktır), Win In Turkey ile Site’ye üye olan Kullanıcı arasında, Kullanıcının Site’ye üye olması amacıyla ve Kullanıcı Sözleşmesi’nin, Site’nin bulunduğu elektronik ortamda Kullanıcı tarafından onaylanması anında düzenlenmiştir.

Site’ye üye olarak, Kullanıcı Sözleşmesi’nin tamamını okuduğunuzu, içeriğini bütünü ile anladığınızı ve tüm hükümlerini onayladığınızı kabul, beyan ve taahhüt etmektesiniz.

Definitions
Win In Turkey: Win In Turkey

User: A real or legal person who is a member of the Site and benefits from the services offered on the Site within the conditions specified in this User Agreement.

The website: A website composed of the domain name wininturkey.com and its affiliated subdomains.

Win In Turkey Services (Shortly "Service"): Provided by Win In Turkey, with the aim of allowing Users to perform the transactions defined in the User Agreement within the Site, applications implemented within the Site.

Win In Turkey may make changes and/or adaptations to its services at any time to enable Users to perform the transactions defined in the User Agreement more effectively.

 

Subject and Scope of the Agreement
3.1 The subject of the User Agreement is the determination of the services offered on the Site, the conditions for benefiting from these services, and the rights and obligations of the parties.

3.2 The scope of the User Agreement is all the statements, texts, and explanations made by Win In Turkey regarding the use, membership, and services on the Site, along with the User Agreement and its appendices.

3.3 By accepting the provisions of the User Agreement, you also agree to comply with all the terms and rules stated by Win In Turkey and any other announcements regarding the use, membership, and services within the Site.

 

Membership and Service Usage Conditions
4.1 Membership is completed by sending the necessary identity information to the Site by the person who wants to become a User and the registration process is completed by Win In Turkey's approval of the registration. Without completing the membership process, the right and authorization to become a User defined in this User Agreement cannot be claimed.

 

Rights and Obligations
5.1. Rights and Obligations of the User

a) When performing the membership procedures, benefiting from the services on the Site, and performing any transactions related to the services on the Site, the User agrees, declares, and undertakes to act in accordance with all the terms stipulated in the User Agreement, the rules specified in the relevant sections of the Site, and the current legislation, acknowledges that they understand all the terms and rules mentioned above and endorse them.
b) In cases of claims of violation of the rights of third parties, as required by the Privacy Policy and the provisions of the current mandatory legislation, the User accepts, declares, and undertakes that Win In Turkey is authorized to disclose their own confidential/special/trade information to official authorities and the right holders and that no compensation can be claimed from Win In Turkey under any name.
c) The security of the access tools (username, password, etc.) used to access the system is entirely the responsibility of the Users. Users, for all the negligence and faults related to the security, storage, keeping away from the knowledge of third parties, and use of the access tools to the system, are solely responsible for the damages that Users and/or third parties will suffer due to their use, and Win In Turkey has no direct or indirect responsibility.
d) Users are solely responsible for the accuracy and legality of the information and content they provide and publish on the Site, as they accept, declare, and undertake that Win In Turkey does not investigate the accuracy of the information and content submitted, changed, or provided by Users, does not guarantee that these information and contents are secure, accurate, and legal, and will not be held responsible for any damages that may arise from incorrect or defective information and content.
e) Users cannot transfer their rights and obligations in the User Agreement, in whole or in part, to any third party without the written consent of Win In Turkey.

f) Users benefiting from the services provided by Win In Turkey and those who use the site can only conduct activities on the site for legal purposes. Users are solely responsible for the legal and criminal consequences of their actions and activities within the site. Each User agrees, declares, and undertakes that they will not reproduce, copy, distribute, process, in any way infringe upon the intellectual or personal rights or property of Win In Turkey or any other third party, either directly or indirectly, through the images, texts, visual and auditory images, video clips, files, databases, catalogs, and lists available on the Site, whether by these actions or by other means, and that they will not engage in competition with Win In Turkey directly and/or indirectly through these actions.

Win In Turkey shall not be held responsible in any way, directly and/or indirectly, for the damages incurred or that may be incurred by third parties due to the activities carried out by Users on the Site in violation of the User Agreement and/or the law.

g) The responsibility of Win In Turkey, its employees, or managers does not exist for the services provided on the Site by third parties, including Users, and for the content published. The accuracy and legality of the information, content, visual and auditory images published by any third party is entirely the responsibility of the individuals who perform these actions. Win In Turkey does not guarantee the security, accuracy, and legality of the services and content provided by third parties, including Users.
h) Users acknowledge, declare, and undertake that this User Agreement shall be valid in all kinds of media in which the Site operates, including mobile platforms.
i) Win In Turkey, at its own discretion, provides Users with the opportunity to receive promotional and informational messages sent by Win In Turkey, which will be made by Win In Turkey. Users agree, declare, and undertake that they approve the sending of all kinds of information and promotional messages through mobile platforms as well as the media where the Site operates. Users have the right to make changes regarding the receipt of informative and promotional messages through the settings in their user account.

5.2. Rights and Obligations of Win In Turkey

a) Win In Turkey reserves the right to change the Services and content offered on the Site at any time. Win In Turkey also reserves the right to block and delete access to the information and content uploaded to the system by Users, including third-party access, and may exercise this right without notice or prior approval. Users are obliged to promptly comply with any changes and/or corrections requested by Win In Turkey. If necessary, Win In Turkey may make the requested changes and/or corrections. Any damages that may arise due to Users' failure to make changes and/or corrections requested by Win In Turkey will be entirely the responsibility of the Users.
b) Win In Turkey may provide links to web sites and/or portals, files, or content owned and operated by third-party sellers, providers, and other third parties not under the control of Win In Turkey on the Site. These links may be provided by Users or by Win In Turkey solely for reference convenience. The links to the portals, websites, files, and content accessed through the links or websites do not imply any statement or warranty of any kind about the services provided or the products within these websites or websites accessed through these links. Win In Turkey has no responsibility regarding the services or content offered through these links on the Site.
c) Win In Turkey does not act as a mediator or arbitrator in disputes arising between Users concerning the Services and Products provided on the Site.
d) Win In Turkey may perform content and/or message scanning to detect messages and/or content that violate the operation of the Site and/or the User Agreement and/or general rules of the Site and/or general ethical rules among Users on the Site. It may access and remove the messages and/or content it detects at any time and in any manner. Win In Turkey may provide written warnings to the User who created the message and/or content, or terminate the User's membership, temporarily or permanently, without any notice, if it determines that the message and/or content has not been acted upon in a timely manner by the Users in response to the requested changes and/or corrections.
e) Users and Win In Turkey are legally independent parties. No partnership, representation, or employer-employee relationship exists between them. The acceptance and implementation of this User Agreement do not create a partnership, representation, or employer-employee relationship between Users and Win In Turkey.
f) Usernames or "project" names that Users upload to the system when creating a User profile within the scope of this User Agreement are subject to the provisions contained in this User Agreement. Users must not violate the legal rights of third parties, such as copyright, trademark, and trade name, when determining their "username" or "project" name. If Users act contrary to this provision, Win In Turkey may request the correction of this situation as a violation of the User Agreement and, if desired, may terminate the User's membership temporarily or permanently without prior notice.
 

Services
The fundamental services provided by Win In Turkey involve facilitating communication between Companies and Users, as well as providing project presentations between Companies and Users through the Site.

Companies can send project presentations to Users through email.

7.1. Additional Services

Users, subject to paying the fees specified by Win In Turkey for the additional services, can benefit from Additional Services including Shop Service, Showcase Service, and Listing Service, in addition to the aforementioned Services.
 

User Profile Review System

a) Users are solely responsible for the legal and criminal consequences of their comments when creating a User profile and adding new comments to the User profile. Win In Turkey will not accept any legal responsibility for the comments in User profiles.

b) Users may not engage in behavior that manipulates the User Profile Review System in any way or under any pretext, using any method. If they do, they agree, declare, and undertake that they will reimburse all damages that Win In Turkey will realize in connection with the subject, and that Win In Turkey has the right to terminate the User's membership temporarily or permanently without any notice.

c) The comments added to User profiles by Users will not be changed by Win In Turkey under any conditions, as detailed in the section "Changes in the User Profile" in User profiles.

d) Users may not transfer their User profiles created for themselves to another User under any condition, nor may they allow usage in any way. Users who transfer their User profile created for themselves to another person or make it available for use, acknowledge, declare, and undertake that Win In Turkey has the right to unilaterally terminate the User Agreement and terminate the User's membership without notice.

Privacy Policy

Win In Turkey may use information related to Users in accordance with the provisions of the Privacy Policy. Except for cases allowed by the User Agreement and the Privacy Policy, confidential information about Users is not provided to third parties.

 

 

Other Provisions
10.1. Intellectual Property Rights

a) All elements of the Site (including design, text, images, HTML code, and other code, but not limited to these) are owned by Win In Turkey as intellectual property rights, or used under license from third parties. Users may not resell, share, distribute, display, reproduce, create derivative works from, or prepare or allow others to access or use Win In Turkey's services and information and works subject to Win In Turkey's intellectual property rights. Otherwise, they will be responsible for compensating Win In Turkey for any damages claimed by third parties, including licensors, as well as court costs and attorney's fees, among others.

b) Win In Turkey's services, information, intellectual property rights, trademarks, commercial appearance, and all material and intellectual property rights, real and personal rights, commercial information, and know-how related to Win In Turkey are reserved.

c) Users agree, declare, and undertake that they will comply with the rules regarding the use of Win In Turkey's Brand and Logo.

10.2. Contract Changes

a) Win In Turkey, entirely at its discretion and unilaterally, can change this User Agreement and its attachments at any time it deems appropriate by announcing it on the Site. The amended provisions of this User Agreement will take effect on the date they are announced or, if a validity date is specified, on the validity date; the remaining provisions will continue to be in effect unchanged, continuing to produce their judgments and results. This User Agreement cannot be changed by the unilateral statements of the User.

10.3. Force Majeure

In all cases legally deemed as 'force majeure', Win In Turkey is not obliged to fulfill any of the obligations specified in this User Agreement due to late or incomplete performance, non-performance, or failure to perform. In such cases, delay, incomplete performance, or non-performance or default will not be considered for Win In Turkey, and no compensation can be claimed from Win In Turkey under any name. The term 'force majeure' is interpreted as events that are beyond the reasonable control of the relevant party, which they could not prevent despite taking necessary care, including but not limited to natural disasters, rebellion, war, strike, communication problems, infrastructure and internet breakdowns, power cuts, and adverse weather conditions.

10.4. Applicable Law and Jurisdiction

Turkish Law will be applied in the application, interpretation, and management of legal relationships arising within the framework of this User Agreement. In the settlement of any kind of dispute arising from or may arise from this User Agreement, Istanbul Courts and Execution Offices are authorized.

10.5. Termination of the Contract

This User Agreement will remain in effect as long as the User is a member of the Site and will continue to produce judgments and results between the parties; it will be deemed terminated in cases where the User's membership expires or is temporarily or permanently suspended. In case the Users violate this User Agreement and/or similar rules related to usage, membership, and services within the Site, especially in the following cases, Win In Turkey can unilaterally terminate the User Agreement, and Users will be obliged to compensate all damages incurred by Win In Turkey due to the termination:

a) If the User engages in behavior that manipulates the operation of the Site using any method,

b) If the User transfers or allows others to use the User profile created for themselves,

c) If the User engages in activities that infringe upon the rights of third parties or pose a risk of infringement.
